Short title.

A Proclamation concerning ownership of or interest in

Leasehold premises and damages sustained thereby.

WHEREAS it is necessary to meke provision for recording claims of title to or interest in leasehold premises in the Colony and any damage which may have been sustained thereby in consequence of military operations or enemy occupation and further for temporarily restricting transactions in relation to such premises

:

NOW, THEREFORE, IT IS HEREBY PROCLAIMED as follows :-

1. This Proclamation may be cited as the Leaseholds Proclamation, 194

"Owner" includes any person holding premises direct from the Crown,whether under lease, licence or otherwise, and also any person who, as assignee of the leasehold interest or otherwise, is receiving or entitled to receive the rent or profits of any premises,solely or as joint tenant or tenant in common with others,or on behalf of any other person,or who would so receive the rent or profits or be entitled to receive the same if the premises were let to a tenant; and,where such owner as above defined cannot be found or ascertained or is absent from the Colony or is under disability, the agent of such owner; and for the purposes of this Proclamation a mortgagee, whether in possession or otherwise,shall be deemed an owner.

"Person" includes a company, firm or association or body of persons corporate or unincorporate.

Owner to 3 (1). Every owner of leasehold premises shall, within three months

lodge after a date to be fixed by the Chief Civil Affairs Officer and statement. notified in the Gazette, lodge with the appropriate officer

mentioned in sub-section (3) of this section a statement of his ownership or other interest in such premises.

Form L, 1.

Such statement shall be in the form L, 1. in the Schedule to this Proclamation and shall give the particulars required therein.

(2).The owner shall at the time of lodging such statement produce for inspection all receipts for Crown rents, rates and other charges paid by him or on his behalf since the 24th day of June, 1941, and shall permit copies to be made thereof or extracts taken therefrom and shall, if required,deliver the same into the custody of such officer as aforesaid on being given a receipt therefor.

(3).The offieer with whom the statement of ownership or interest shall be lodged shall be i-

(a) Except in the case of the New Territories (other than that portion thereof known as New Kowloon and any land exempted from the provisions of the New Territories Regulation Ordinance, 1910, under section 13 of that Ordinance), the officer appointed to be Land Officer, Hong Kong .

(b) In the case of the New Territories

other than New

Kowloon and lands exempted as mentioned in the preceding paragraph) the officers appointed to conduct the

administration of civil affairs in the Northern and Southern Districts of the New Territories respectively.
